Li Shu’s Team Obtains Increased Liquidated Damages on Appeal in a Property Purchase Dispute

After paying hundreds of millions of renminbi for property, the client faced a developer’s failure to deliver the property and complete the transfer. A jointly controlled account arrangement was approaching expiry, making asset protection urgent. The matter arose during Shanghai’s pandemic restrictions, which affected court operations and communication.

Li Shu’s team prepared the strategy and documents and communicated with the court, completing pre-action preservation before the account control arrangement expired. YunTing had separately reported on this preservation stage.

Because the first-instance judgment only partly supported the client’s claims, the team appealed. It organized the relevant facts and arguments concerning liquidated damages and made submissions to the appellate court.

According to YunTing’s case account, the appellate court increased the liquidated damages payable by the developer.
