Li Shu’s lecture series on commercial factoring law and practice is intended for factoring company managers, legal, compliance and risk personnel, lawyers and participants in supply chain finance. YunTing published the course introduction on 4 February 2024.
The series is organized into six themes: the factoring industry, legal framework and regulation; regulatory requirements under Document No. 205; factoring issues under the Civil Code and the Ninth National Courts’ Civil and Commercial Trial Work Conference Minutes; typical products and transaction structures; enterprise risk management; and litigation, asset preservation, enforcement and the interaction between criminal and civil proceedings.
Specific topics include the authenticity, assignment and registration of receivables; recourse and non-recourse factoring; order and invoice factoring; pooled and future receivables; repurchase clauses; jurisdiction; assignment notices; the effects of insolvency; and objections to enforcement. The course combines legal rules, product structures and case analysis.
